WHO'S AT FAULT FOR AN ACCIDENT?

WHAT AN INSURANCE COMPANY MUST COVER?
Usually, a person who is liable for an accident -- and therefore his or her liability insurance company -- must pay an injured person for:

  • Medical care and related expenses
  •  Damaged Property
    • Income lost because of the accident, because of time spent unable to work or undergoing treatment for injuries
    • Permanent physical disability or disfigurement
    • Loss of family, social and educational experiences, including missed school or training, vacation or recreation, or a special event

    Immediately after being injured in an accident, you are probably angry, in pain and maybe a little depressed.
    But taking some important steps in the first few days after your accident can make the entire claim process easier on you -- and increase your chances of receiving all the compensation to which you are entitled. [ More ]

    BEFORE YOU SUE  
    Think hard before you rush off to the court clerk's office to file a lawsuit. The idea of victory may tempt you, but as you probably know, lawsuits can be expensive, time-consuming and emotionally draining. It's far better to resolve your disputes out of court.

    One way to do this is through mediation, discussed below. And there are other ways to settle disputes without suing, including demanding payment before you go to court or attempting informal negotiation. But if all else fails and a lawsuit seems inevitable, you'll want to be sure you have a good case and prepare yourself well before you forge ahead.
